GENERAL PROVISIONS:

This Extended Warranty provides for reimbursement to the Warranty Holder for the Reasonable Cost of the repair or replacement of any Covered Equipment if required due to a Mechanical or Electrical Breakdown during the Warranty Period, subject to the Items Not Covered, Limit of Liability and other conditions stated below.

Reasonable Cost is defined as the lesser of the charges for the repair or replacement of covered parts at prevailing labor rates, using parts of like kind and quality, which may include remanufactured parts as customarily used in the industry. At the sole option of the Warranty Administrator, the Covered Equipment may be replaced with equipment providing similar functionality.

Covered Equipment is defined as the machine or apparatus which the Warranty Holder owns, and which is described and specified under this Equipment Breakdown Extended Warranty.

Mechanical or Electrical Breakdown is defined as the sudden failure of a defective mechanical or electrical part, component or assembly of the Covered Equipment which occurs during and as a result of the ordinary, proper and customary use of such Covered Equipment.

Coverage provided by this Extended Warranty only applies during the Warranty Period and within the Warranty Territory as stated below.

Coverage provided by this Extended Warranty is subject to a Limit of Liability and Deductible as indicated.

Coverage provided by this Extended Warranty requires the prior approval of the Warranty Administrator as stated below.

This Extended Warranty does NOT warrant the tolerances, throughput, quality, safety, efficiency, utility or any other capability of the Covered Equipment. It ONLY applies to Mechanical or Electrical Breakdown as defined above.

Equipment must be in serviceable operating condition before it can suffer a Mechanical or Electrical Breakdown.

This Equipment Breakdown Extended Warranty will not pay to repair or replace breakdowns, defects or any other damage that occurred prior to the time you took possession of the Covered Equipment.

WARRANTY PERIOD

This Extended Warranty only covers Mechanical or Electrical Breakdowns that take place during the Warranty Period.

The Warranty Period begins at 12:01 a.m. local time at the location of the Covered Equipment on the indicated Warranty Effective Date.

The Warranty Period ends at 12:01 a.m. local time at the location of the Covered Equipment on the indicated Warranty Expiration Date.

This Extended Warranty will expire whether or not the Covered Equipment is installed or used during the Warranty Period.

The Extended Warranty shall not be effective unless the Warranty Holder has fully paid for the Covered Equipment.

WARRANTY TERRITORY

This Extended Warranty applies only while the Covered Equipment is located within the United States of America, Canada, Mexico or Puerto Rico. This Extended Warranty is not available for equipment sold or used in Alaska, Maine, New Mexico or North Dakota.

LIMIT OF LIABILITY

Total payments under this Extended Warranty for any One Breakdown will never exceed the indicated Warranty Limit. The Warranty Holder is solely responsible for any costs that exceed the Limit of Liability.

If the Warranty Administrator chooses to replace the Covered Equipment, this Extended Warranty will be terminated upon your receipt of the replacement equipment.

For the purposes of the Limit of Liability and the Deductible, One Breakdown is defined as all Mechanical or Electrical Breakdowns occurring at the same time from the same event. If a Mechanical or Electrical Breakdown causes other Mechanical or Electrical Breakdowns, all will be considered One Breakdown.

DEDUCTIBLE

Coverage provided by this Extended Warranty is subject to the indicated Warranty Deductible. This Warranty Deductible applies separately to any One Breakdown. If costs covered under this Extended Warranty do not exceed that amount, there will be no payment under this Extended Warranty. If covered costs do exceed that amount, this Extended Warranty will only pay for that portion of the costs that exceeds the Warranty Deductible up to the indicated Warranty Limit.

The term One Breakdown is defined in the Limit of Liability section above.

SALVAGE AND SUBROGATION RIGHTS

The provider of this Extended Warranty has salvage rights to any property replaced using payment from this Extended Warranty, to the extent of such payment. However, there can be no abandonment of any property to the warranty provider or administrator.

The provider of this Extended Warranty will be subrogated to all of the Warranty Holder's rights of recovery against any person or organization to the extent of its payment. The Warranty Holder shall execute and deliver instruments and papers and do whatever else is necessary to secure such rights. The Warranty Holder will do nothing after a loss to prejudice such rights.

ITEMS NOT COVERED

There is no coverage under this Extended Warranty for any of the following:

  1. Equipment damaged by faulty or negligent decommissioning.
  2. Equipment damaged while in transit or storage.
  3. Equipment damaged by faulty or negligent installation.
  4. Any Mechanical or Electrical Breakdown that occurs outside of the Warranty Period.
  5. Any repair or replacement undertaken without prior notice to, and approval from, the Warranty Administrator.
  6. Any Mechanical or Electrical Breakdown that is not reported to the Warranty Administrator within 4 days of the breakdown.
  7. Upgrades, improvements or any costs exceeding the Reasonable Cost.
  8. Any Mechanical or Electrical Breakdown involving a part or component that has been added, substituted or modified subsequent to its sale, unless the work was performed by or authorized by the dealer issuing the warranty.
  9. Any tooling, molds, dies, felts, screens, bulbs, blades, chains, belts or any part subject to periodic replacement.
  10. Any Mechanical or Electrical Breakdown due to fire, lightning, explosion, windstorm or hail, collision, riot, vandalism, water damage, earth movement, flood, war or nuclear reaction, radiation or contamination.
  11. Loss caused by an intentional act, willful neglect, intentional overloading, improper testing, or the imposition of abnormal conditions.
  12. Any costs to test, correct or replace software.
  13. Cosmetic restoration or repair of conditions, which are not related to the effective operation of the Covered Equipment.
  14. The in-house labor or materials of the Warranty Holder, unless specifically approved by the Warranty Administrator.
  15. Damage to any property other than the Covered Equipment specified under this Extended Warranty.
  16. Loss of business, additional expenses or any other incidental or consequential loss.
  17. Equipment not owned by the Warranty Holder at the time of the Mechanical or Electrical Breakdown.
  18. Equipment rented, leased or loaned to any third party or operated by any third party outside of the Warranty Holder’s control.
  19. Erosion or corrosion.
  20. Theft.
  21. Loss or expense covered under any manufacturer’s warranty, recall, or any other valid and collectible guarantee or warranty.

WARRANTY HOLDER RESPONSIBILITIES

In order to keep this Extended Warranty in force during the full Warranty Period, the Covered Equipment must be installed, used and maintained in accordance with the manufacturer's requirements. This includes providing appropriate shelter, rotation and lubrication prior to installation. The Covered Equipment must not be used at any time for any purpose other than its intended, normal and customary purpose. In the event of a Mechanical or Electrical Breakdown, the Warranty Holder must use all reasonable means to protect the Covered Equipment from further damage. When requested, the Warranty Holder must allow the Warranty Administrator to inspect damaged parts or equipment. 

SUBMITTING A CLAIM

To obtain coverage under this Extended Warranty, contact the Warranty Administrator at any of the following numbers for assistance and instructions prior to any work being performed. Coverage under this Extended Warranty will be void if the Warranty Holder does not notify the Warranty Administrator within 4 days of the Mechanical or Electrical Breakdown.

DOCUMENTING A CLAIM

In order to qualify for any payment under this Extended Warranty, the Warranty Holder will need to provide the Warranty Administrator with documentation proving the eligibility of the Covered Equipment and the actual amount of the covered loss.

LIMITATIONS

THIS EXTENDED WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES EXPRESS OR IMPLIED. NO WARRANTY IS MADE AS TO THE MERCHANTABILITY OR FITNESS OF THE EQUIPMENT FOR ANY PARTICULAR PURPOSE. THE WARRANTY HOLDER’S ONLY REMEDIES ARE EXPRESSLY LIMITED TO THE LESSER OF THE COST TO REPAIR OR REPLACE THE COVERED EQUIPMENT SUBJECT TO THE LIMIT OF LIABILITY AND OTHER CONDITIONS STATED HEREIN. THIS LIMIT IS REGARDLESS OF WHETHER THE WARRANTY HOLDER ELECTS TO UNDERTAKE THE MORE EXPENSIVE ALTERNATIVE. THIS EXTENDED WARRANTY IN NO WAY PROVIDES FOR ANY OTHER LOSSES, DAMAGE OR EXPENSE CLAIMED BY THE WARRANTY HOLDER.

LEGAL ACTION

Any cause of action arising under this Extended Warranty must be brought within twelve (12) months of the expiration of the Warranty Period. This Extended Warranty shall be governed by and construed in accordance with the laws of the state of Connecticut, without giving effect to conflict of laws principles.

WARRANTY HOLDER

This Extended Warranty is issued to a specified Customer who has purchased Covered Equipment through the dealer issuing the warranty. Except as noted below, the rights and interests under this Extended Warranty may not be transferred to any other party.

If the Customer listed on this Extended Warranty is an individual or a department within a company or organization, the rights under this Extended Warranty are extended to the Customer’s company or organization.

The Warranty Holder under this Extended Warranty may not be a consumer as defined in the Magnuson-Moss Warranty Federal Trade Commission Improvement Act.

FINANCED PURCHASES

If the Warranty Holder indicated on this Extended Warranty has financed the purchase of the Covered Equipment, that Warranty Holder will be considered the owner of the Covered Equipment as respects the terms of this Extended Warranty. Payments made by a bank or other finance company on behalf of the Warranty Holder will meet the requirement that Covered Equipment be paid for by the Warranty Holder.

EXCLUSIVE OBLIGATION

This Extended Warranty is exclusive. The Warranty Holder's sole and exclusive remedy, and the sole and exclusive obligation of the warranty provider and Warranty Administrator, is for the repair or replacement of the defective Covered Equipment in the manner and for the period specified. The dealer issuing the warranty and The Hartford Steam Boiler Inspection and Insurance Company have no other obligation under this Extended Warranty, whether based in contract, tort, strict liability or otherwise. Under no circumstances, whether based on this Extended Warranty or otherwise, shall the dealer issuing the warranty or The Hartford Steam Boiler Inspection and Insurance Company be liable for incidental, special or consequential damages.

OTHER STATEMENTS

No statement, oral or written, outside of this Extended Warranty document constitutes a warranty. No employee of the dealer issuing the warranty or The Hartford Steam Boiler Inspection and Insurance Company has the authority to change or amend this Extended Warranty.

WARRANTY ADMINISTRATOR

This Extended Warranty is underwritten and administered by The Hartford Steam Boiler Inspection and Insurance Company.
